1. Conclusion of the contract

1.1 The contract procedure starts with the booking request. By making a booking request, the customer offers Aguamonte Tours S.L.U. (‘Aguamonte Tours’) the possibility to conclude a contract in accordance with the pre-contractual information provided. The booking request can be made orally, in writing, by telephone, fax or electronically.

1.2 The person making the booking request, if he/she does so not only on his/her own behalf but also on behalf of other participants and/or a minor of whom he/she is the parent or guardian, is liable not only for the fulfilment of his/her own obligations but also for the fulfilment of the obligations of the other participants.

1.3 The contract is concluded by the acceptance of the booking request by Aguamonte Tours and is binding for both parties. Aguamonte Tours will confirm the acceptance of the booking through its computer system.

2. Payment

Upon receipt of the booking confirmation, the client must pay Aguamonte Tours 100% of the total price of the campus. This amount must be paid within 48 hours of receiving the booking confirmation.

Failure to pay this amount will deprive the contract of all effectiveness.

3. Services

The services to be provided by Aguamonte Tours will be those derived from the fulfilment of the obligations established in the offer, in the present general conditions, as well as in the particular conditions of the contract.

4. Cancellation by the client

4.1.- At any time prior to the start of the campus the client can unilaterally terminate the contract by written communication addressed to Aguamonte Tours.

4.2.- If the client unilaterally withdraws from the contract, Aguamonte Tours will have the right to demand a compensation from the client that will be fixed according to the following table:

– If the cancellation is communicated up to 30 days before the start of the tour: 50%.

– If the cancellation is communicated from the 29th to the 22nd day (both inclusive) before the start of the tour: 50%: 75%

– If the cancellation is communicated from the 21st to the 1st day before: 100%.

These percentages will be applied to the total price agreed.

4.3.- In cases of cancellation by the client, the refund of the appropriate amount will be made by Aguamonte Tours within 14 calendar days of receipt of written communication from the client of their desire to withdraw.5. Price reduction.

5. Cancellation of the campus due to failure to reach the minimum number of participants or as a result of unavoidable and extraordinary circumstances, as well as in cases of non-compliance by the client:

5.1.- Aguamonte Tours may cancel the contract and reimburse the client for the full amount paid, but will not be liable for any additional compensation if:

– a) the number of people registered for the campus is less than the minimum number specified in the contract and Aguamonte Tours notifies the traveller of the cancellation within the maximum period of:

1.º twenty calendar days before the start of the campus in the case of campuses lasting more than six days,

2nd seven calendar days before the start of the campus in the case of campuses lasting between two and six days,

3rd forty-eight hours before the start of the camp in the case of campuses lasting less than two days, or

– b) the organiser is prevented from performing the contract by unavoidable and extraordinary circumstances and notice of cancellation of the camp is given without undue delay before the start of the camp.

5.2.- Aguamonte Tours will refund any payment made by or on behalf of the client for the campus, less the corresponding penalty. Such refunds or reimbursements will be made to the client without undue delay and, in any case, within a period not exceeding fourteen calendar days after the termination of the campus contract.

5.3.- Likewise, Aguamonte Tours will have the right to unilaterally terminate the contract if the client fails to comply with the obligations assumed under the contract, persists in his conduct despite the requirements made or, in general, violates the content of the contract.

In this case, Aguamonte Tours can terminate the contract without notice. In doing so, Aguamonte Tours reserves the right to claim the price of the campus from the client.

6. Limitation of liability of the operator

The contractual liability of Aguamonte Tours is limited to three times the total price of the campus. Such limitation of liability shall not apply to bodily injury or damage caused intentionally or through negligence.

7. Insurance

The campus price does not include insurance (e.g. campus cancellation costs, foreign health insurance, etc.).

Aguamonte Tours recommends the conclusion of a campus cancellation insurance and an insurance to cover assistance costs, including return transport in case of accident, illness or death, as well as a health insurance that is also valid abroad.

8. Data Protection

Aguamonte Tours informs its clients that the treatment and processing of their personal data will be carried out in accordance with the terms indicated in the privacy policy that can be found on the website www.aguamonte.com

8.1.- Aguamonte Tours declares to comply with the provisions contained in the current regulations on the protection of personal data. All data relating to the person (e.g. name, surname, address, email address, among others) are considered personal data.

This data will be processed to the extent necessary for the proper processing of the booking request, to carry out a pre-contractual action or to verify the fulfilment of the contract.Contact details:

8.2.- The data will only be transmitted to authorised third parties who require the data in order to execute the contract negotiated between the parties, always in accordance with the provisions of current legislation on the protection of personal data.

8.3.- The client has the possibility at any time to request information about the data stored by Aguamonte Tours, change them or delete them.

8.4.- The personal data is deleted if the customer revokes his consent to the storage, if the data is no longer necessary for Aguamonte Tours to fulfil the purpose for which it was stored or if its storage is unlawful by law.

8.5.- The customer has all the rights derived from the privacy policy.

8.6.- The client may exercise their rights of access, rectification, cancellation, opposition or any others that may correspond to them or make the relevant queries by email to the address service@aguamonte.com.
